USCIS is purging all E-Verify records that are more than 10 years old. E‑Verify employers have until Dec. 31, 2019, to download your case information from the Historic Records Report for all of your E-Verify cases that were created on or before Dec. 31, 2009.

Why should you care? Because the government can still audit you and demand that you prove that you did your part to ensure your worker(s) were legally authorized to work in the U.S.

Since the government is purging its own records, the only proof you’ll have left for defending yourself will be whatever records you have yourself. Telling the government that you have no records is not the kind of discussion you’ll want to be having.

This is part of a larger discussion about records retention. But no need to boil the ocean right now. Just download your data, and set a reminder for December 31st of every year to download your data.
